Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. THIS SWEEPSTAKES IS NOT OPEN TO THE GENERAL PUBLIC. YOU MUST BE A U.S. CITIZEN, ARIZONA RESIDENT, 21 YEARS OF AGE OR OLDER, AND NOT BE PROHIBITED FROM POSSESSING A FIREARM to ENTER OR WIN THE SWEEPSTAKES.
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO THESE OFFICIAL RULES.
- Eligibility – The Meet and Greet On Sight Sweepstakes (the “Sweepstakes”) is open only to U.S. citizens who are twenty-one (21) years or older, reside in Arizona, and are not prohibited firearms possessors under Federal or State law (as described below) (“Eligible Entrants”). Void where prohibited by law. No purchase necessary to enter the Sweepstakes. Dan Neidig and the Tiffany Shedd for Congress Committee, 111 W. Florence Blvd., Suite 7, Case Grande, AZ 85122 (“Administrator/Sponsor”), or any of their respective affiliates, subsidiaries, or any other company or individual involved with the design, production execution or distribution of the Sweepstakes (collectively with Sponsor and Administrator, the “Sweepstakes Entities”) and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members of each such person are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state, municipal, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and the Sweepstakes Entities’ decisions, which are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.
- Odds – Odds of winning depend on the number of eligible entries received.
- When to Enter – The Sweepstakes begins on 1/14/2020 at or shortly after 5:30 PM Arizona Time (the “Event”) and ends on 1/14/2020 at or shortly after 7:00 PM Arizona Time (the “Entry Period”).
- How to Enter – To enter the Sweepstakes, you must be an Eligible Entrant, personally attend the Event, and complete and submit a Sweepstakes entry form to the Administrator during the Entry Period. Limit one (1) Sweepstakes entry per Eligible Entrant in this Sweepstakes.
- Compliance with Firearm Laws As Condition to Enter – To enter and be qualified to win the Sweepstakes, you cannot be a prohibited firearm possessor under Federal or State law. A prohibited firearm possessor includes (but is not necessarily limited to) an individual who: has been convicted of a felony and not had his/her civil rights restored; has been convicted of a crime punishable by imprisonment exceeding one year; has been convicted of a misdemeanor crime of domestic violence; is currently serving a term of imprisonment; is on probation, parole, community supervision, work furlough, home arrest or any other release based on a conviction for domestic violence or a felony offence; is subject to a court order regarding harassment, stalking, or threatening an intimate partner or child of an intimate partner; is a fugitive from justice; is an unlawful user of any controlled substance; has been found incompetent or mentally incapacitated by a court; has been found to be a danger to his/herself or others, have a persistent, acute, or grave disability, or committed to a mental institution pursuant to a court order; has been found guilty but insane by a court; has renounced his/her U.S. Citizenship; is not lawfully present in the United States; or was discharged from the Armed Forces under dishonorable conditions. By entering the Sweepstakes and completing a Sweepstakes entry form, you agree, verify and affirm that you are not a prohibited firearms possessor under Federal or State law.
- Completion of Firearms Transaction Records and Submission to Background Check – Sweepstakes winner must complete (or assist the Sponsor completing on the winner’s behalf) any firearm purchase/transfer/transaction documentation required under Federal or State law, including but not limited to a Firearms Transaction Record (ATF Form 4473). Sweepstakes winner must also submit to a NICS background check to be conducted by the Sponsor. Sweepstakes winner agrees to cooperate with Sponsor with these and any other like requirements, including payment of fees. Failure to comply with this paragraph will preclude Sweepstakes winner from taking ownership or possession of the prize; in that event, the Sweepstakes Entities will not hold a new Sweepstakes or otherwise conduct a new drawing.
- Privacy Policies and Data Collections – By participating in the Sweepstakes, entrant authorizes the Sweepstakes Entities to collect, use, process, transfer and store all data provided by entrant, including without limitation, personal data, to location(s) that such Sweepstakes Entity deems necessary, and with such party(ies) as they deem appropriate, for purposes of promotion and administration of the Sweepstakes. All information submitted to the Sponsor as part of this Sweepstakes will be treated in accordance with the Sponsor’s privacy policy, available at https://sheddforcongress.com/privacy-policy. Personal information will be used only to: (a) comply with federal election law reporting; (b) provide future communications from the Administrator; and/or (c) if an entrant selects to receive additional information from Sponsor or Administrator on the Sweepstakes entry form, to send additional promotional information to that entrant after the Sweepstakes has concluded. Entrants have the right to withdraw and correct their personal data, but entrants are not allowed to re-submit their entries.
- Winners Selection – There will be only one prize winner in this Sweepstakes. The potential winner will be randomly selected by Administrator from among all eligible entries received during the Entry Period. Winner must be present to win.
The Sweepstakes Entities’ decisions as to the administration and operation of the Sweepstakes, and the selection of the potential winner, are final and binding in all matters related to the Sweepstakes. Failure of a potential winner to promptly acknowledge the prize selection immediately following the Sweepstakes drawing will result in disqualification and an alternative potential winner may be selected.
- Verification of Potential Winners – In order to be confirmed as a winner, and without limitation of any other terms herein, each potential winner may be required upon Sponsor’s reasonable request to provide satisfactory proof, as determined by Sponsor in its sole discretion, that such potential winner is an Eligible Entrant, including but not limited to providing a copy of a potential winner’s government-issued identification and/or additional information required by Sponsor in order to verify eligibility and compliance with these Official Rules and applicable Federal and State laws.
In addition to the firearm purchase requirements outlined in paragraph 6 above, the prize winner will be required to sign and return to Sweepstakes Entities, within five (5) days of the date notice is sent, an affidavit of eligibility and liability/publicity release (except where prohibited) in order to claim his/her prize, and such other documents as Sponsor and/or Administrator deem necessary in their sole discretion (collectively, “Prize Claim Documents”). Each Eligible Entrant understands that the Sponsor or its respective agents may advise the United States Internal Revenue Service (IRS) of the value of the prize awarded to such Eligible Entrant in the form of an IRS Form 1099, or otherwise. Each Eligible Entrant understands that prior to being entitled to receive any prize, and prior to receiving any prize, such Eligible Entrant may be required to first provide Sponsor with all of such Eligible Entrant’s applicable taxpayer identification information and other required and reasonably requested tax and tax-related documentation (e.g., an IRS Form W-9, Request for Taxpayer Identification Number and Certification). If any potential winner declines in writing to accept a prize, such required information or Prize Claim Documents are not returned within the specified time period, or a potential winner is not otherwise in compliance with these Official Rules, the prize will be forfeited and, at the Sponsor’s sole discretion and time permitting, Sponsor may select an alternate winner from all remaining eligible entries. There will be three (3) alternate drawings after which the prize will remain unawarded. If the potential winner refuses or fails to sign and return the Prize Claim Documents within the required time period, such potential winner may be disqualified and may forfeit his/her prize. Upon verifying the prize winner, Sponsor will make arrangements with the winner to transfer possession of the prize.
- Prize and Approximate Retail Value – The prize is an Armsan Tristar Viper Bronze 12 Gauge Shotgun. Serial number d8a26023Approximate Retail Value (“ARV”) of the prize: $679.00. Prize consists only of the elements expressly set forth above; no other elements or attachments (including ammunition) are included in the prize and all such expenses are the sole responsibility of prize winner.
The Sweepstakes Entities are not responsible if any part thereof the prize cannot be awarded for any reason, including due to any acts of God, action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Sponsor’s or Administrator’s control.
The Sweepstakes Entities will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to prize winner or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize.
Prizes are non-transferable, non-negotiable, non-refundable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize or reward for one of equal or greater value for any reason. All taxes (including, without limitation, state and federal income taxes) and the reporting consequences thereof associated with the use and acceptance of a prize is solely the responsibility of each winner. Other restrictions may apply.
- Publicity – By accepting any prize, entrant grants the Sweepstakes Entities and their agents permission to use entrant’s name, likeness, voice, and biographical information for publicity or advertising in any media or manner now known or hereafter devised, without further payment, consideration, notice or approval (other than the specific prize described herein) to entrant, his/her successors or assigns, or any other entity, and without geographic or time limitation, except as prohibited by law.
- Release and Indemnification – By participating in the Sweepstakes, each entrant agrees to release and hold harmless the Sweepstakes Entities from and against any and all claims, costs, expenses, losses, damages and liability (including, without limitation, reasonable attorneys’ and investigation fees, expert and consultant fees, and other litigation costs) (collectively, “Losses”) arising out of participation in the Sweepstakes. In the event that an Eligible Entrant breaches any of these Official Rules, Sweepstakes Parties shall be entitled to and may seek indemnification, to the extent permitted by law, from Eligible Entrant for recovery of all Losses that may be incurred by Released Parties as a result of the aforementioned breach.
- General Conditions – In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, as determined by Sweepstakes Entities in their sole discretion, then the Sweepstakes Entities may either: (a) suspend or postpone the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize from among the non-suspect, eligible entries received up to the time of the impairment. The Sweepstakes Entities reserve the right, in their sole discretion, to disqualify any individual they find to be tampering with the participation process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in a disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sweepstakes Entities reserve the right to seek damages from any such person to the fullest extent permitted by law. Only the type of prize described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sweepstakes Entities’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- Disputes/Governing Law – Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, other than those concerning the administration of the Sweepstakes or the determination of winners or for any disputes arising from the loss or injury from the participation in a prize, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (iv) any disputes arising out of these Official Rules shall be submitted to the Maricopa County Superior Court. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules.
